These Terms and Conditions ("Agreement") govern the use of services provided by Review Monsoon LLC. ("we," "our," "us") to our clients ("Client" or "you"). By using our services, you agree to abide by these terms. If you do not agree to these terms, please do not use our services.
1. Services Provided
We provide services to help businesses collect customer reviews through third-party review platforms. These services include, but are not limited to:
Facilitating the collection of customer reviews on behalf of our clients. Providing tools to manage and track review requests. Offering consultation and support related to reputation management.
2. Client Responsibilities
As a Client, you agree to:
Provide Accurate Information: You will provide accurate, complete, and up-to-date information about your business and your customers as required for us to perform our services.
Obtain Consent: You are responsible for ensuring that your customers have consented to receive review requests via email, phone, sms, or other communication methods.
Comply with Laws: You agree to comply with all applicable local, state, and federal laws, including data protection and privacy laws.
No Fraudulent Reviews: You agree not to engage in or promote the creation of fraudulent or misleading reviews. All reviews should reflect genuine customer experiences.
3. Review Collection
We help our Clients collect reviews by reaching out to customers on their behalf, using contact information provided by the client. You acknowledge that the collection and submission of reviews are conducted through third-party review platforms (such as Google, Facebook, Instagram, Yelp, etc.). Review Monsoon LLC is not responsible for the actions or decisions made by these third parties, including their policies or review removal actions.
4. Client and Customer Data
We may collect and store personal data, including contact information, from both our Clients and their customers for the sole purpose of providing our services.
Data Security: We will implement reasonable security measures to protect the data we collect. However, we cannot guarantee the absolute security of your information.
Data Usage: Client and customer information will only be used for the purpose of performing the review solicitation services. We will not sell or rent this data to third parties without your explicit consent.
5. Payment Terms
Our services are provided on a [monthly/annual] subscription or per-project basis as agreed upon. Clients will be invoiced as per the terms of the agreement made at the time of purchase. Clients will be billed automatically for any services provided. By agreeing to these terms, you authorize automatic billing on the specified payment method for recurring or one-time charges as applicable. Payments will be processed according to the billing cycle agreed upon, and you are responsible for ensuring the payment method is up to date. Late Payments: Payments must be made within [7] days from the date of invoice. Late payments may result in suspension of services until payment is received.
6. Liability Disclaimer
No Guarantee of Reviews: We make no guarantees regarding the quantity or quality of reviews that will be generated through our services. The success of review solicitation depends on multiple factors, including customer response rates and the review policies of third-party platforms.
Limitation of Liability: Review Monsoon LLC is not liable for any damages arising from the use of our services, including but not limited to errors, omissions, or actions taken by third-party review platforms. Our liability is limited to the amount paid for the services within the [6] months preceding any claim.
Indemnification: You agree to indemnify, defend, and hold harmless Review Monsoon LLC, its employees, contractors, and affiliates from any claims, damages, or liabilities arising from your use of our services or from any breach of these Terms and Conditions.
7. Termination
You may terminate this Agreement at any time by providing written notice to us 30 days in advance. Upon termination, we will cease providing services, but any outstanding payments due will remain payable. We reserve the right to terminate or suspend your access to our services if we believe you have violated these Terms and Conditions.
8. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of providing the services. This includes business practices, data, and customer information.
9. Changes to Terms and Conditions
We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted on our website, and the revised Terms and Conditions will take effect immediately upon posting. It is your responsibility to review these terms periodically.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Oklahoma, United States of America. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts located in Oklahoma, United States of America.
SMS Messaging Terms & Compliance
Program Description: This messaging program sends Google Review Requests messages to customers who have been provided a service with specific companies that work with Review Monsoon LLC. for the purpose of reputation management and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include Google Review requests and customer support communications.
Cancellation Instructions: You can cancel the SMS service at any time. Simply text “STOP” to the same number that sent you messages. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following the confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
Support information: If you experience issues with the messaging program, reply with the keyword “HELP” for more assistance, or reach out directly to [email protected].
Carrier Liability: Carriers are not liable for delayed or undelivered messages.
Message and Data Rates: Message and data rates may apply for messages to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.
Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers. Age Restriction: You must be 18 years or older to participate in our SMS program.

General Terms
